By agreeing to purchase a product from Cheer Creativity (the artist) and sending payment, you are indicating that you (the client) have read and agree to all of the terms outlined below. Anything agreed upon by both parties in writing, including electronically, is binding.  

Conditions of Sale:

Clients must be 16 years or older to commission art from me.

I require a clear reference image of the client’s character with flat colors for any commission type other than a reference sheet. All characters must belong to the client. I will not accept AI-generated images or references. If commissioning a portrait of a person/pet, please provide lots of images for a clear understanding.

More complex characters will add extra fees. I have the right to refuse a commission. I will NOT draw the following:

• NSFW - this includes any fetishes/erotic/sexual elements.

• Mechs/Machinery

• Extreme gore

• Explicit concepts

• Anything sexist, overly violent, racist, or otherwise derogatory towards anyone or any group
   

Payment:

All payments are through Square or PayPal invoice. The client is responsible for the 3% credit card processing fee imposed by Square and PayPal. All quotes and payments are in USD. Tracked shipping is included for all domestic packages within the US where applicable. International clients are responsible for currency conversion fees, if applicable, and any import/customs fees applied by their country when shipping.

Payment is taken upfront in full and must be paid within 48 hours of the commission being accepted.

Cancellations and Refunds: 

A 50% refund may be issued after the sketch is completed. No refunds will be issued after a sketch is approved.  I reserve the right to cancel and refund clients where applicable. If an unexpected event occurs that impacts my productivity (i.e., a family emergency or illness), I will notify the client as soon as possible and provide refund options based on the level of commission completion. 

Progress Updates and Communication:

I will send progress photos to the client for approval before continuing forward. This includes the initial sketch phase and a flat color stage (for digital pieces). Revisions are allowed within reason, and I will do my best to remedy any mistakes and implement feedback. I will communicate via Telegram (preferred), Discord, Instagram, or email. I may post progress photos to my Telegram channel and social media accounts unless specified otherwise beforehand. Finished art commissions will be emailed as PNGs. Other file formats may be requested. All artwork will be watermarked upon completion. If requested, an unwatermarked version can be sent to the client. The commission belongs to both the client and me. If the client posts my commission work, they must credit me.

Commercial Rights: 

The client may not resell my art for a profit. My art is under my copyright and therefore cannot be sold unless sold by me. If commissioning something for commercial use (e.g., logo, t-shirts), extra fees and royalties will apply. Clients cannot use my art in anything AI-related. Doing so will result in being blacklisted.
